By using ClearMD, you agree to these terms. If you do not agree, please do not use our service.

ClearMD is a web-based platform that provides AI-powered Markdown enhancement services. We convert Markdown content into polished, interactive HTML using artificial intelligence. By accessing and using our platform, you acknowledge that you have read and agree to be legally bound by these terms and conditions.

1. Service Description

ClearMD offers AI-powered Markdown-to-HTML conversion services through various access plans, including Guest Access, Free Registered Users, Credit Packs, and Pro subscriptions. Our service processes your Markdown input and generates enhanced HTML output using third-party large language model APIs.

2. AI-Generated Content Disclaimer

All content generated through our AI services may contain errors, inaccuracies, biases, or outdated information. AI-generated content is inherently unpredictable and may include inappropriate material, factual errors, offensive content, or other defects. You must not rely on AI-generated content for legal, medical, financial, academic, or professional advice without independent verification by qualified professionals.

AI-GENERATED OUTPUTS DO NOT CONSTITUTE PROFESSIONAL ADVICE OF ANY KIND, INCLUDING BUT NOT LIMITED TO LEGAL, FINANCIAL, MEDICAL, TECHNICAL, OR OTHER LICENSED PROFESSIONAL ADVICE.

We provide no human oversight, fact-checking, or content guarantees. You use all AI-generated content entirely at your own risk and are solely responsible for verifying and validating any information before acting on it. We are not liable for any decisions, actions, or outcomes resulting from your use of or reliance on AI-generated content.

3. User Accounts and Responsibilities

You agree to use the service legally and ethically, provide accurate account information, keep your login credentials secure, and not share your account or bypass usage limits. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Age Requirement: You must be at least 13 years of age to use ClearMD. If you are under 13, you may not use the service or create an account. If you are between 13 and 16 years of age (or the age of legal majority in your jurisdiction), you may use the service only with the consent and supervision of a parent or legal guardian. By creating an account or using the service, you represent and warrant that you meet these age requirements. If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will delete that information as quickly as possible.

4. Prohibited Uses

You may not use ClearMD to:

• Generate content that violates any applicable law or regulation
• Infringe upon or violate any third-party rights, including intellectual property, privacy, or publicity rights
• Harass, abuse, threaten, or intimidate any person or entity
• Distribute malware, viruses, or other harmful code
• Attempt to gain unauthorized access to our systems or other users accounts
• Interfere with or disrupt the integrity or performance of the services
• Scrape, data mine, or use automated systems to access the services beyond normal use
• Impersonate any person or entity or falsely state or misrepresent your affiliation
• Use the services for any commercial purpose beyond your authorized subscription level
• Resell, redistribute, or sublicense access to the services without authorization

We reserve the right to suspend or terminate your account immediately without notice or refund if you violate these terms or engage in fraudulent or abusive behavior. We may also report illegal activities to appropriate law enforcement authorities.

5. Subscriptions, Credits, and Payments

ClearMD operates on a credit-based system. Free users receive a limited number of credits each month. Paid subscriptions and credit packs provide additional credits and features. Subscriptions automatically renew until you cancel through your account settings. You are responsible for keeping your payment information current and managing your subscription.

We may modify pricing, features, or service availability with thirty days advance notice. By purchasing any service, you authorize us and our payment processors to charge your designated payment method for all applicable fees, including subscription fees and any applicable taxes.

6. Refund Policy

All purchases are final and non-refundable worldwide. This applies to Credit Packs, Pro Monthly subscriptions, and Pro Annual subscriptions. Once payment is processed, no refunds will be issued regardless of usage, subscription duration remaining, or any other circumstance.

If you experience technical issues preventing you from using ClearMD, contact us at support@clearmd.xyz and we will work to resolve them promptly. Technical issues are not grounds for a refund, but we are committed to ensuring the service works for you.

EU and UK Consumer Withdrawal Right: If you are a consumer located in the European Union, European Economic Area, or United Kingdom, you have a statutory fourteen (14) day right of withdrawal beginning from the date of purchase confirmation. This withdrawal right applies only if you have not yet accessed or used any part of the purchased service. Once you have used any conversion feature or accessed any paid capability of ClearMD, your right of withdrawal is forfeited under digital content regulations. To exercise your withdrawal right for unused services, contact us at support@clearmd.xyz within fourteen days of purchase before using any service.

Australia Consumer Rights: If you are located in Australia, nothing in this refund policy excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law, including any applicable consumer guarantees for digital products and services.

7. Payment Processing

All payment processing is handled by Stripe, our third-party payment processor. We are not responsible or liable for payment processing errors, delays, or failures; unauthorized charges resulting from payment processor data breaches or security incidents; payment processor fees, policies, or terms of service; failed transactions, declined payments, or payment disputes; chargebacks, payment reversals, or bank disputes; or changes to payment processor services or availability.

8. Data Processing and Third-Party AI Providers

Our service processes your inputs using third-party artificial intelligence API services to generate responses. These providers are contractually prohibited from using your data to train their models or for any purpose beyond processing your immediate request. We implement industry-standard security measures for data transmission and storage, but cannot control third-party AI providers practices beyond our integration points.

Your use of the service constitutes consent to data processing as described in our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy carefully to understand how we collect, use, protect, and share your information.

9. Intellectual Property

We own all rights to the ClearMD platform, including but not limited to source code, software, branding, logos, trademarks, designs, algorithms, technology, documentation, and all related intellectual property, which are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of your original input content that you submit to the services. Subject to these Terms and your subscription plan, you may use AI-generated outputs for personal or business purposes in accordance with your authorized use level.

You hereby grant ClearMD a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, process, transmit, display, reproduce, and modify your content solely as necessary to provide, maintain, improve, and protect the services to you. This license includes the right for ClearMD and its third-party service providers to process your content through artificial intelligence and machine learning APIs to generate outputs. You represent and warrant that you have all necessary rights to grant this license and that your content does not violate any third-party rights or applicable laws.

You may not copy, modify, adapt, translate, or create derivative works from our platform, code, or systems; reverse engineer, decompile, disassemble, or attempt to discover the source code or underlying algorithms; remove, alter, or obscure any copyright, trademark, or other proprietary notices; redistribute, resell, lease, sublicense, or transfer access to the services; frame or mirror any part of the services without our express written permission; or use our trademarks, logos, or branding without authorization.

10. Limitation of Liability

To the maximum extent permitted by applicable law, our total aggregate liability for all claims of any kind shall not exceed the greater of: (a) the total amount paid by you to ClearMD in the twelve (12) months immediately preceding the event giving rise to liability, or (b) one hundred dollars ($100.00 USD).

In no event shall we be liable for any indirect, incidental, special, exemplary, consequential, or punitive damages of any kind, including but not limited to loss of profits, revenue, sales, or business opportunities; loss of data; cost of substitute services or procurement of replacement goods; business interruption; damage to reputation, goodwill, or brand value; claims by third parties based on your use of the services or AI-generated content; or any damages arising from reliance on AI-generated content or outputs.

Our liability for any and all claims arising from or relating to AI-generated content shall not exceed one hundred dollars ($100.00 USD) in the aggregate for all such claims combined.

11. Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the service will immediately cease.

12. Changes to Terms

We may update these Terms from time to time. Continued use of ClearMD after any changes constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ClearMD operates, without regard to its conflict of law provisions.
